ITALY: 2026, THE YEAR AHEAD FOR EMPLOYERS.

The year 2025 is marked by important developments in the field of labour law in Italy, with significant repercussions expected in 2026. Angelo Zambelli analyzes the new measures in the article: Italy: 2026, the year ahead for employers, published on L&E GLOBAL website.

 

1️⃣ The Italian Constitutional Court again reviewed the Legislative Decree no. 23/2015 (Provisions on permanent employment contracts with increasing protection over time, implementing Law no. 183/2014, the so called “Jobs Act”), this time with reference to the maximum cap of six months salary in cases of unlawful dismissals for employers with fewer than fifteen employees.

2️⃣ Law no. 106/2025 introduces significant innovations concerning the safeguards granted to employees, both in the public and private sectors, who are affected by oncological, chronic, or disabling conditions.

3️⃣ With judgement no. 156/2025, the Italian Constitutional Court once again addresses Article 19 of the “Workers’ Statute,” expanding its scope by granting trade unions with a high level of representativeness the possibility to establish company-level union representatives, regardless of whether they signed and/or participated in the negotiation of the collective agreement applied in the company.

4️⃣ The new Law Decree no. 159/2025 introduced urgent changes in the field of training, promotion, and spread of principles on health and safety in the workplace with strengthened protections and applicable penalties.

5️⃣ The 2024 European Regulation on Artificial Intelligence (AI Act) has been implemented in Italy through Law no. 132/2025, which, in line with the provisions of the European Regulation, sets out principles, obligations, and sanctions to ensure the ethical and responsible use of AI.
